Product Safety & Regulatory Compliance

Blissed Skin is committed to the highest standards of product safety, quality, and regulatory compliance. We take our responsibility to our customers seriously and follow all applicable laws and regulations.

FDA Cosmetic Regulations:

• All Blissed Skin products are formulated and labeled in compliance with the Federal Food, Drug, and Cosmetic Act (FD&C Act) and FDA cosmetic regulations (21 CFR Parts 700-740)
• Our products are classified as cosmetics, not drugs, and are intended for cleansing, beautifying, promoting attractiveness, or altering appearance
• Products are properly labeled with ingredient lists in accordance with FDA requirements (descending order of predominance)
• We comply with FDA color additive regulations and prohibited/restricted ingredient lists

Manufacturing Standards:

All products are manufactured in FDA-registered facilities following Good Manufacturing Practices (GMP) as outlined in FDA guidance for cosmetics. Manufacturing partners are regularly audited for quality assurance and compliance. Batch testing and quality control procedures are implemented for every production run. Products undergo stability testing to ensure quality throughout shelf life.

Safety Assessments:

Safety assessments are conducted for all formulations before market release. Assessments consider ingredient safety, concentrations, intended use, and potential exposure. Products are evaluated for microbiological contamination. pH testing ensures products are appropriate for skin contact. Stability testing confirms product integrity over expected shelf life.

Adverse Event Reporting:

User-Generated Content Policy

By submitting reviews, testimonials, photos, videos, or other content ("User Content") to Blissed Skin through our website, social media, email, or any other means, you agree to the following terms:

License Grant:

You grant Blissed Skin LLC a non-exclusive, transferable, sub-licensable, royalty-free, perpetual, irrevocable, worldwide license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User Content in any media formats and through any channels, including but not limited to: our website and blog, social media platforms, email marketing campaigns, product packaging and marketing materials, advertisements (online and offline), and press releases and media kits. We may use your name, username, likeness, and profile information in connection with your User Content. You understand that your User Content may be shared with our business partners, affiliates, and marketing agencies.

Representations and Warranties:

You represent and warrant that: you own or have all necessary rights, licenses, consents, and permissions to submit the User Content and grant the license described above; your User Content does not violate any laws, third-party rights (including copyright, trademark, privacy, publicity, or other personal or proprietary rights), or our Terms of Service; your User Content is truthful, accurate, and not misleading; and if your User Content includes identifiable individuals (other than yourself), you have obtained their consent to submit and use their image/likeness.

Prohibited Content:

You agree not to submit User Content that: is false, deceptive, or misleading; is defamatory, obscene, pornographic, vulgar, or offensive; promotes discrimination, bigotry, racism, hatred, harassment, or harm; promotes illegal activities or violates any laws; infringes on intellectual property or other rights; contains viruses, malware, or harmful code; includes unsolicited advertising or spam; or impersonates any person or entity.

Incentivized Reviews:

If you received a free product, discount, or other incentive in exchange for your review, you must clearly disclose this fact in your review. We do not compensate for positive reviews, and all reviews must be honest and based on your genuine experience.

Governing Law & Jurisdiction

These legal terms and any disputes arising out of or related to them or your use of our website and products shall be governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions.

Choice of Law - Washington State: By using Blissed Skin services or purchasing our products, you consent to the application of Washington State law, which governs major e-commerce platforms and provides comprehensive consumer protection frameworks. The substantive laws of Washington State, without reference to choice of law principles, shall govern these Terms and any dispute between you and Blissed Skin LLC, except to the extent that federal law applies (e.g., copyright, trademark, Federal Arbitration Act).

Jurisdiction and Venue: For any disputes not subject to arbitration (see Dispute Resolution section), you agree to submit to the personal and exclusive jurisdiction of the state and federal courts located in King County, Washington. You waive any objection to jurisdiction and venue in such courts based on inconvenient forum or any other grounds.

Federal Law Applicability: Where applicable, federal law governs certain aspects including: Copyright and trademark protection (U.S. Copyright Act, Lanham Act); Consumer product safety (Consumer Product Safety Act); Cosmetic regulation (Federal Food, Drug, and Cosmetic Act); Electronic communications (CAN-SPAM Act, TCPA).

Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.

Statute of Limitations: You agree that any claim arising from your relationship with Blissed Skin must be filed within one (1) year after such claim arose; otherwise, your claim is permanently barred.

Dispute Resolution

In the event of a dispute, we encourage you to contact us first to seek an informal resolution. Most concerns can be resolved quickly and amicably through direct communication.

Informal Resolution:

Before initiating formal dispute resolution procedures, you agree to contact us at legal@blissedskin.com and provide a detailed description of the dispute. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within 30 days after submission, you or Blissed Skin may initiate formal dispute resolution (mediation or arbitration).

Mediation:

If informal resolution is unsuccessful, both parties agree to participate in good faith mediation before pursuing arbitration or litigation. Mediation will be conducted by a neutral third-party mediator. Each party will bear its own costs of mediation. If the dispute is not resolved through mediation within 60 days, either party may proceed to arbitration.

Arbitration:

If mediation is unsuccessful, any remaining dispute shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Consumer Arbitration Rules. The arbitration will be conducted in [County], [State], or another mutually agreed location, or remotely via telephone or videoconference if both parties agree. The arbitrator's decision will be final and binding, and judgment on the award may be entered in any court with jurisdiction. Class Action Waiver:

You agree that any dispute resolution proceedings, whether in mediation, arbitration, or court, will be conducted only on an individual basis and not as part of a class, consolidated, or representative action. You may not consolidate your dispute with claims of any other person or entity.

Exceptions:

Either party may seek injunctive or other equitable relief in court to protect intellectual property rights (trademarks, copyrights, trade secrets). Either party may bring a claim in small claims court if it qualifies and remains in small claims court. Claims related to personal injury or property damage may be brought in court rather than arbitration.

Costs and Fees:

For arbitration claims under $10,000, Blissed Skin will pay all arbitration filing fees and arbitrator fees. For claims exceeding $10,000, fees will be allocated according to AAA rules. Each party will bear its own attorney's fees unless the arbitrator awards them to the prevailing party as permitted by law.

Opt-Out:

You may opt out of this arbitration agreement by sending written notice to Blissed Skin LLC at [Address] within 30 days of your first purchase or account creation, whichever is earlier. Your opt-out notice must include your name, address, email, and a clear statement that you wish to opt out of the arbitration agreement.

Severability

If any provision of these legal terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions shall remain in full force and effect.

Partial Invalidity:

If any provision of these legal terms is deemed invalid, unlawful, void, or unenforceable by a court of competent jurisdiction, such provision shall be deemed severable and shall not affect the validity and enforceability of the remaining provisions, which shall remain in full force and effect.

Modification of Invalid Terms:

If any provision is held unenforceable, it shall be reformed to the minimum extent necessary to make it enforceable while preserving its intent, or if reformation is not possible, such provision shall be severed from these terms.

Survival of Valid Provisions:

The invalidity or unenforceability of any provision shall not affect the effectiveness of the other provisions, which shall continue to bind the parties according to their terms.
